By accessing or using The Happy Clinic's website, telehealth consultations, or any related services ("Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Services.
2. About Our Services
The Happy Clinic provides telehealth consultations with AHPRA-registered doctors for the assessment and management of chronic health conditions. Our services include eligibility assessments, doctor consultations, prescription management, and medication dispensing through licensed pharmacies.
3. Use of Services
- Eligibility: You must be 18 years or older and located in Australia to use our Services.
- Your Responsibility: You must provide accurate and complete information during appointments and online forms.
- Emergency Disclaimer: We do not offer emergency medical services. Call 000 for urgent help.
- The Happy Clinic uses an automated system to help ensure that product prices remain fair and that we are able to offer a wide variety of products to all patients. Where a patient requests that their prescription(s) be transferred or removed from The Happy Clinic's system, we reserve the right to charge an administration fee of $15 per prescription to cover processing and administrative costs.
4. Telehealth Consultations
- Consultations are conducted via secure telehealth platforms.
- Your doctor will assess your condition and determine whether treatment is appropriate. There is no guarantee of a prescription.
- All prescriptions are subject to TGA approval under the Special Access Scheme or Authorised Prescriber pathway.
5. SMS Consent
- By checking the SMS consent checkbox on our forms, you:
- Agree to receive messages about your health, appointments, and clinic promotions.
- Understand that message frequency varies, and message and data rates may apply.
- Acknowledge that you can unsubscribe anytime by replying STOP or contacting us.
6. Payments & Refunds
- Consultation Fees: Listed on the website and payable in advance.
- Refund Policy: Full refunds for cancellations made with 24+ hours' notice. Less than 24 hours' notice may incur a fee.
7. Intellectual Property
All content, including videos, copy, and graphics, is owned by The Happy Clinic Pty Ltd and may not be reproduced without permission.
8. Limitation of Liability
We do our best to provide a high-quality experience, but:
- We do not guarantee outcomes or uninterrupted access.
- Our maximum liability is limited to the amount you paid for our services, to the extent allowed by law.
9. Changes to Terms
We may update these Terms at any time. You agree to the latest version by continuing to use our Services.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
